Orizon33 – Terms and Conditions

Welcome to Orizon33. By accessing or using the Orizon33 mobile application or our website at https://www.orizon33.com/ (together, the "Platform"), you agree to be bound by these Terms & Conditions. The Platform is operated by ORIZON33 LLC ("Orizon33," "we," "us," or "our").

1. Acceptance of Terms

By creating an account, continuing as a guest, or using the Platform, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, please do not use the Platform.

2. Accounts

You may sign in with Google or Apple, or browse as a guest. Guest access lets you view products and use a cart, but some features, such as loyalty rewards, referrals, and order history, may require a signed-in account. You must be at least 18 years old, or use the Platform with the permission of a parent or guardian.

3. User Responsibilities

• Provide accurate and up-to-date information.
• Maintain the security of your account and sign-in credentials.
• Use the Platform only for lawful purposes.
• Notify us promptly at contactus@orizon33.com of any unauthorized use of your account.

4. Products, Pricing, and Orders

Product descriptions, images, and prices are provided in good faith but may occasionally contain errors. We may cancel an order if an item is unavailable, incorrectly priced, or if we suspect fraud, and we will refund any payment made. An order is confirmed only when you receive a confirmation in the app. Order statuses (confirmed, processing, in transit, ready for pickup) and delivery or pickup times are estimates, not guarantees.

5. Payments

• Card payments are processed securely by Stripe, Inc. We do not store your complete card details.
• Pay in Person (Instantly Buy, Pay Later) lets you reserve items now and pay when you collect them. Reserved items are held for a limited period shown at checkout. If you do not collect and pay in time, we may cancel the order. Repeated missed pickups may result in this option being disabled for your account.

By placing an order, you confirm you are authorized to use the selected payment method.

6. Delivery and Pickup

Orders are fulfilled through Orizon33's delivery and pickup network. You are responsible for providing accurate contact and delivery or pickup details. Please bring your order confirmation and, if requested, valid ID when collecting an order.

7. Cancellations, Returns, and Refunds

You may cancel an order before it is marked "processing." Returns and refunds are handled according to our return policy shown in the app or on our website. Approved refunds are issued to the original payment method. Nothing in these Terms limits your statutory consumer rights.

8. Loyalty Rewards

You earn loyalty points on eligible purchases and may redeem them for discounts as shown in the app. Points have no cash value, cannot be transferred or sold, and may be removed if an order is refunded or if points were earned through misuse. We may change or end the program with reasonable notice.

9. Refer & Earn

You may share your referral code with friends. Rewards are granted when a referred friend joins and completes the qualifying action described in the app. Self-referrals, fake accounts, and spam are prohibited and may result in loss of rewards or account termination.

10. Product Sharing and Notifications

You may share product links from the app. Opening a shared link on a device with the app installed opens the relevant product. With your permission, we send push notifications about orders and offers; you can turn them off at any time in your device settings.

11. Privacy

Your personal information is handled in accordance with our Privacy Policy.

12. Prohibited Activities

• Attempting unauthorized access to the Platform or other users' accounts.
• Uploading or distributing malicious or harmful content.
• Using bots, scrapers, or automated tools, or interfering with the Platform's operation.
• Abusing promotions, rewards, or referrals.
• Violating applicable laws or regulations.

13. Intellectual Property

The Platform and its content, including software, design, logos, and trademarks, belong to Orizon33 or its licensors. You may use the Platform for personal, non-commercial purposes only.

14. Disclaimers and Limitation of Liability

The Platform is provided "as is" and "as available." To the extent permitted by law, we are not liable for indirect, incidental, or consequential losses, and our total liability for any claim is limited to the amount you paid for the relevant order. Nothing in these Terms limits liability that cannot be limited by law.

15. Termination

We may suspend or terminate your account if you violate these Terms. You may stop using the Platform and delete your account at any time.

16. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will update the Effective Date and notify you through the Platform where appropriate. Continued use of the Platform constitutes acceptance of the revised Terms.

17. Governing Law

These Terms are governed by the laws of the State of [State], United States, without regard to conflict-of-law rules, subject to any mandatory consumer protections in your place of residence.
